Terms of service

These terms govern the use of PropertyBoost.ai (the "Service"), provided by DataTreasure Ltd (the "Provider"). By signing the order form or otherwise using the Service, the customer agrees to be bound by these terms.

1. The Service

PropertyBoost.ai is an AI-driven lead reactivation and content generation product for UK estate agents. The exact deliverables, branch count, and tier are set out in the order form signed with each customer.

2. Fees and payment

  • A one-off setup fee, as specified on the order form (early-bird from £1,500, standard £4,500).
  • A recurring monthly per-branch subscription, billed in advance.
  • A minimum term of approximately 12 months unless otherwise agreed.
  • Late payment may attract interest under the Late Payment of Commercial Debts (Interest) Act 1998.

3. Customer responsibilities

  • Providing CRM access and lawful authority to process the contained personal data.
  • Designating a point of contact for onboarding and operational matters.
  • Complying with applicable estate-agency, consumer, and data-protection law.

4. Data protection

The Provider acts as a Data Processor for customer CRM data, under a Data Processing Agreement that supplements these terms. Personal data is processed inside the UK and EU.

5. Intellectual property

The Service, including all software, models, prompts, and templates, remains the Provider's intellectual property. The customer receives a non-exclusive licence to use the Service for the duration of the contract.

6. Confidentiality

Each party will keep the other's confidential information confidential and use it only to perform under these terms.

7. Liability

The Provider's total aggregate liability under these terms is capped at the fees paid in the twelve months preceding the event giving rise to the claim. Neither party excludes liability for fraud, death or personal injury caused by negligence, or any liability that cannot be excluded by law.

8. Term and termination

  • The contract continues for the minimum term, then renews monthly unless cancelled with 30 days' notice.
  • Either party may terminate for material breach not remedied within 30 days of written notice.

9. Governing law

These terms are governed by the laws of England and Wales, and the parties submit to the exclusive jurisdiction of the English courts.
